The Esso Extra loyalty program is no longer active.

New members who sign up for Esso Extra on or after October 6, 2020 will be subject to the following rules immediately upon registration, while existing members will be subject to the rules starting on January 1, 2021.

Imperial Oil, a partnership, represented herein by its managing partner, Imperial Oil Limited ("Imperial"), owns and operates the Esso ExtraTM Program (the "Program"), which is subject to the following rules.

1, Introductory Remarks

1.1 Subject to these rules, Members of the Program ("Members") will receive Esso Extra Points ("Points") for purchases made at participating EssoTM stations and select MobilTM stations in Canada ("Participating Stations") that are part of the Program. Gas stations that are in close proximity to Loblaw-branded supermarkets are excluded from the Program. Members can get cool stuff by trading in their Points, as long as they follow these guidelines. Unless otherwise specified, "Members" refers to the Master Member, Authorized Redeemer(s), and Joint Member(s) of a joint account. Authorized Contacts are not Members; let that be clear.

1.2 These regulations cover three distinct types of Points: regular Points, bonus Points, and special Points. Unless otherwise specified, the term "Points" refers to all three types of points: base, bonus, and promotional.

1.3 Not all Esso and Mobil stations are required to participate in the Program; for example, Mobil stations located in close proximity to Loblaw-banner grocery store properties may be excluded.

Points can be redeemed by Canadian residents only 1.4 who have registered their profile on essoextra.com or by calling 1-800-567-3776 and providing their full name, valid mailing address, and valid email address. For Program participation, Members must have a current Esso Extra card. Both single and married members are limited to a single account for Points. Members can only be natural persons.

When making a purchase with (a) a PC Financial Mastercard® or (b) a PC Optimum loyalty card, Members will not earn Points. In the event that a Member earns points through another loyalty program for the same purchase, those points will not be awarded.

Two Different Kinds of Accounts

2.1 Points can be accumulated by a Member either individually or jointly with another Member or Members. Any account to which Points are being added by two or more Members is considered a joint account. Businesses are not allowed to form this, but families, communities, and other associations are. In order for Members to share Points, they must submit a Link Accounts Form, with a designation of a "primary collector" ("Master Member"), to the address listed on the form. Any Authorized Redeemer(s) (as defined in Section 4) and the Master Member. They (and only they) will be able to add Points to and withdraw Points from the joint account. Contributions of Points to a joint account are limited to those members ("Joint Member(s)") who are neither Master Members nor Authorized Redeemers. A Responsible Party (as defined in Section 2.) Members (up to 5) of a Master Member or Authorized Redeemer can use the account's Points to make purchases. The number of accounts that can be linked to a single Imperial account may be capped. After Imperial receives and processes the duly completed Link Accounts Form, the joint account will be established within two to three weeks.

2.2 Only a Master Member can add Points to a Joint Account, and only if they are also Members. In a joint account, only one person can be designated as the Master Member. The Master Member must be an individual with a position of authority within the community group that established the joint account.

2.3 When dealing with a shared bank account Any Master Member who (a)notifies Imperial in writing that he or she no longer wishes to serve as Master Member, (b)notifies Imperial that he or she no longer wishes to serve as a Member of the joint account, (c)dies, or (d)becomes bankrupt or incompetent to manage his or her own affairs shall automatically cease to be a Master Member. Points currently held in the shared account will be The Members shall be entitled to receive their proportionate share (based on the amount of contributions made to the Joint Account) of any redemptions upon receipt and registration of written notice by Imperial. Imperial shall not be liable to any Member(s) of the joint account or any other person or entity for any redemption of Points made by a Master Member notwithstanding anything to the contrary herein. prior to Imperial's receipt of satisfactory written notice, and registration in its records, of the Master Member's desire to no longer be the Master Member, no longer be a Member of the joint account, or the death of any Member of the joint account. due to the Master Member's insolvency or inability to perform Following the procedure outlined in Section 2, the remaining Members may submit a written request to designate a new Master Member. 1

An individual who is not a Master Member or its Authorized Contact (as defined in Section 2.3) may contact the Company at any 5.) may request to be removed from a joint account by submitting an Unlink Accounts Form to the address indicated on the form, or by contacting the Customer Service and Support Centre (1-800-567-3776) and providing proof of identity as a Member or the Authorized Contact. If a Member who is not the Master Member requests to be removed from a joint account, Imperial will transfer the Member's Points from the joint account to the Member's individual account pro rata to the Member's actual contributions to the joint account. the joint account minus their respective percentage of redemptions processed prior to the change being recorded by Imperial (based on the amount contributed to the joint account). After either (a) Imperial receives and registers the properly completed Unlink Accounts Form; or (b) the Member or its Authorized Contact has been verified and requests such change from Customer Service and the Member's Points are removed from the joint account, the process takes about 2 to 3 weeks to complete. Facilitation Hub

A Member may designate an authorized contact ("Authorized Contact") in their account settings at any time. The term "Authorized Contact" refers to a Member's designated representative who, with limited exceptions, has the authority to act on the Member's behalf in all matters pertaining to the Member's account and may also redeem Points on the Member's behalf. Each Member is limited to adding a single Authorized Contact. To add an Authorized Contact, a Member must verify their identity as the account holder and provide information about the Authorized Contact's relationship to the Member. Any redemption of Points made by an Authorized Contact prior to Imperial receiving satisfactory written notice of such redemption shall be the sole responsibility of the Member, and Imperial shall not be liable to any Member or any other person or entity for such action or inaction. and recording in its files the Member's request to remove the Authorized Contact or the Authorized Contact's death, bankruptcy, or incapacity.

Extra Points from Esso: 3

When Members make purchases at Participating Stations using the Esso Extra card and any payment method accepted at those locations (other than a PC Financial Mastercard®), the Member will earn 3.1 Base Points. In order to earn base Points, the Esso Extra card must be used during the payment process but before the sale is finalized. Awarding points under 3 is optional unless otherwise stated. One will be activated and redeemable as of the end of the most recent processing period (up to 72 hours). Exceptional Cases g holidays) system operations may cause a delay in this schedule.

Imperial may award Members base Points for purchases of eligible goods and services made at Participating Stations at a rate of one Point for each full dollar spent after tax (excluding cents) in a completed transaction, subject to the limitations and exclusions set forth in these Rules.

3.3 At Participating Stations, with the exceptions specified herein, You can earn three (3) bonus Points for every full dollar after tax (excluding cents) spent on Supreme grade gasoline in a single completed transaction; and two (2) bonus Points for every full dollar after tax (excluding cents) spent on everything else you buy. Premium-grade gas; (c) one (1) bonus Point for every full dollar spent after tax (excluding cents) on Extra-grade gas in a single transaction.

Promotional Points may be awarded to Members for promotional offers, with the exceptions noted below in Section 3.4. details of which will be made available at Participating Stations, online, or through digital communications (emails), while the offer is active and upon fulfillment of the promotion terms and conditions as may be advertised from time to time. advertising materials (banners, etc.) in the quantities specified.

Except as otherwise provided herein, a Member may earn Points when making purchases with an accepted commercial fleet card if the Member's Esso Extra account is in that person's name.

3.6 Available at Selected Locations However, you will not earn points when you (a) make purchases of alcoholic beverages or tobacco products; (b) get a cash advance; (c) buy an Esso or Mobil gift card (but you will earn points in exchange for these cards); or (d) buy an Esso or Mobil gift card. bottle deposits; or (f) specific transactions that do not comply with additional unpublished limitations Imperial has implemented to try to minimize fraud and are not covered by these rules when using Esso and Mobil Gift Cards. These fraud restrictions are mentioned in Section 3. 6(f) are not made public because doing so would provide useful information to a fraudster. Imperial may place restrictions on the total number of Points that can be earned in a single event. 3.7 If a Participating Station's point-of-sale system is down: (i) e When the POS system is back up and running, the cashier will manually enter your transaction if you ask them to. In such cases, you may have to wait up to three days to use your Points.

Points for the original purchase may be reduced or nullified in the event of a credit or refund.

Members will not receive Point balance statements from Imperial (see Section 3.9). 10 and 3 12)

When making a purchase at a Participating Station using a cash transaction, a SpeedpassTM key tag transaction, a SpeedpassTM app transaction, an approved credit transaction, or an approved debit transaction, the Member's individual or joint account Point total will be displayed under Balance; base Points. the current sale's bonus Point, promotional Point, and fuel grade Point totals will be displayed on the receipt under the headings "Base Pts," "Fuel Grade Pts," and "Promo Bonus," respectively. Unless otherwise determined by Imperial in its sole and absolute discretion, the points displayed on the receipt shall be deemed to be accurate.

When a Member discovers a possible discrepancy in his or her Point balance, he or she has 30 days to contact the Customer Service and Support Centre (1-800-567-3776) to have it investigated. Imperial reserves the right to refuse to issue, register, or honour any Points, or to cancel Points if registered, if it determines that the Points were not issued or registered in accordance with these Terms and Conditions (see Section 5). 12)

3.12 Members can check their Point balances in two other ways: (a) by visiting the Esso Extra Program website at www.essoextra.com; or (b) by calling the Customer Service and Support Centre at 1-800-567-9776.

3.13 Points are not redeemable for money or other points. Except as otherwise provided herein, points may be transferred or exchanged. You are not allowed to buy, sell, give away, trade, mortgage, or charge for Points in any way.

In the event of a Member's bankruptcy, all Points in the Member's individual account or contributed to a joint account shall be immediately null and void.

If a Member's account is inactive for a period of twelve (12) consecutive months, meaning that the Member does not earn and/or redeem any Points, all of the Member's accumulated Points will be forfeited. If a Member's Points are set to expire because of inactivity, Imperial will send a notice to the Member (but not the Authorized Contact) at least 30 days and no more than 60 days before the expiration date. and indicating the last day you can use your Points

If all Members of a joint account are inactive for a period of twelve (12) consecutive months without acquiring and/or redeeming any Points, all Points in the joint account will expire.

The joint account's Members (but not the Authorized Contact of any such Member) will receive a notice from Imperial at least 30 days and no more than 60 days before the Points expiration date. alerting them that their Points will expire if they do nothing with them and giving them a specific date by which they must do so

3.17 If a Member's Esso Extra card is lost or stolen, he or she can get a replacement card by visiting any Participating Station. Reference to the previous card must be made on the new Esso Extra card registration form for Points earned on the previous card to be redeemable on the new card. If a card is reported lost or stolen, the cardholder's access to their Points balance will be frozen.

Any Points accumulated in a Member's individual account or contributed to a joint account will be nullified upon the Member's death (as per Section 3.18). Imperial will not take part in any inheritance distribution processes.

3.19 In the event of a Member's divorce or legal separation from his or her spouse, the Member's Points are not assignable or transferable. No divorce settlement involving Imperial will include Imperial.

4 Using Esso Bonus Points to Buy Stuff

Subject to the other limitations set forth in these rules, a Member and its Authorized Contact are the only people who can redeem Points on an individual account. In order to redeem points, they must first be registered. If a Member has accrued enough Points and wants to use them to buy something from the current Loyalty catalog, he or she must do one of the following: (a) for On-Site Rewards (rewards that can be picked up at Participating Stations), the Member or its Authorized Contact must: ask the attendant at a Participating Station to redeem the reward on their Esso Extra card (the attendant will do so immediately, provided the reward is available at that Participating Station). and the Member's total Points will be deducted by the number of Points needed to obtain the reward); or (b) for other rewards (rewards not available at Participating Stations), the Member or its Authorized Contact must: (i) contact the Customer Service and Support Centre (1-800-567-3776); or (ii) access the Member's account online. www.essoextra.com is the online home of the Esso Extra Program. If the Member or its Authorized Contact can be positively identified to Imperial's satisfaction, Imperial will deduct the necessary number of Points from the Member's Point balance and ship the Member the reward, provided the reward is still available at the time of redemption. Allow up to 8 weeks for delivery of your reward.

4.1 1 In an effort to reduce fraud, Imperial has enacted new, unreported restrictions on redemptions. These additional restrictions are not made public because doing so would aid in the commission of fraud.

4.1 Second, a Member can only make a return in the same province as their registered address.

Unless an "Authorized Redeemer" has been designated, the Master Member and its Authorized Contact (if applicable) are the only people who can redeem the Points on a joint account. To be clear, the only thing Joint Members can do with their Points is give them away. The Master Member or its Authorized Contact must request that another Member or Members who collect Points in the joint account be given authority to redeem Points ("Authorized Redeemer") before an Authorized Redeemer can be appointed. Either (a) the Master Member authorizes another Member to redeem any and all Points by submitting a completed Link Account Form to the address indicated on the form, or (b) the Master Member requests such changes by calling the Customer Service and Support Centre (1-800-567-3776) and providing authentication information. After (x) Imperial verifies the identity of the Master Member or its Authorized Contact and approves the request to add the Authorized Redeemer, or (y) approximately 2–3 weeks after Imperial receives and registers the properly completed Authorized Redeemer Form, the Authorized Redeemer will be authorized to redeem Points. Join Your Account Type

When a Master Member, an Authorized Redeemer, or their applicable Authorized Contact has enough Points in a joint account to redeem for a reward from the then-current Loyalty catalogue, the Master Member must make the redemption. The applicable Member's Esso Extra card must be presented by the Authorized Redeemer or Authorized Contact in order to claim an On-Site Reward (which are only available at Participating Stations). to an attendant at a Participating Station and request the reward (the attendant will immediately redeem the reward, provided the reward is available at the Participating Station where the request was made). To redeem a Reward that is not available at a Participating Station, either (a) call the Customer Service and Support Centre (1-800-567-3776) or (b) visit the Esso Extra Program website (www.essoextra.com), and the total number of Points in the joint account will be reduced by the number of Points needed to redeem the Reward. Imperial will deduct the necessary number of Points from the Master Member's or Authorized Redeemer's or Authorized Contact's total Point balance once valid identification of the Master Member or Authorized Redeemer or their applicable Authorized Contact has been provided. In a joint account, the Points contributed by each Member will be reduced by an amount equal to their share of the total contributions made to the account. If the reward is available, it will be shipped to the Master Member or Authorized Redeemer who made the redemption. Allow up to 8 weeks for delivery of your reward.

4.4 Members should not expect a discount or bonus from Imperial on the purchase price of goods when redeeming Rewards. The only thing that Rewards actually are is a way for a Member to cash in their Points.

4.5 Imperial disclaims any liability for missing or stolen prizes. Imperial retains ownership of all points.

4.6 Rewards are nontransferable and have no monetary value.

The Member is exempt from paying any additional sales tax when redeeming a reward. The Member may have to pay a bottle or can deposit in order to receive the reward they've chosen (see also 5). 7)

4.8 Benefits are not guaranteed to be available.

Once a reward has been fulfilled, Imperial does not allow for any changes to be made, exchanges to be made, or refunds to be given.

5 Overview of the Plan

All information provided herein and elsewhere by Imperial with respect to the Program has been thoroughly researched and is believed to be accurate. Any mistakes or omissions are not Imperial's fault.

Imperial's waiver (express or implied) of your strict adherence to and performance of the terms herein will be effective only in the specific instance for which it is given and will not affect Imperial's rights in any other circumstance.

Imperial may, at any time and without notice to Members residing outside of Quebec, suspend, amend, or terminate the Program in whole or in part. Even if this affects Points already recorded or registered, Imperial reserves the right to modify the Program, benefits, and procedures at any time and without notice, unless otherwise required by law. If we decide to end the Program, Imperial may (but is under no obligation to) give Members 60 days' notice before the end of the period in which they can redeem their Points (or such other period as Imperial may determine in its sole discretion) Notices of termination, suspension, or amendment of the Program may be (a)displayed at Participating Stations, (b)published on essoextra.com, (c)sent to the Member's e-mail address on file, and/or (d)provided to any other contact information Imperial may have on file. Except as may be required by law, Imperial is not obligated to give any other notice. If the Program is cancelled, this Agreement will also end, and a Member's Points will expire at the same time; however, Imperial reserves the right, but has no obligation, to extend the expiration date for the Points beyond the cancellation of the Program. in its sole discretion, during which time this Agreement shall remain in effect except for the provisions relating to the accumulation of Points.

Regarding Members residing in Quebec, 5.4 Imperial reserves the right to limit, suspend, amend, or terminate the Program and these rules in whole or in part, including but not limited to:

  • The Program's make-up and ownership;
  • The length of time the Program will run for, including the right to suspend and/or terminate the Program or a Member's participation therein, in whole or in part, at any time;
  • The terms and conditions of enrollment, participation, and membership;
  • Account and joint account administration;
  • How to collect Points at Participating Stations and other retailers, how much different types of Points are worth, what kinds of purchases don't count toward collecting Points, and any other restrictions;
  • The terms and restrictions that govern the use of an Esso Extra card;
  • Details on how and when you can collect, spend, trade, expire, or otherwise make use of Points;
  • Exchange of messages with Members, Master Members, Authorized Redeemers, and/or Joint Members as appropriate;
  • Members', Master Members', Authorized Redeemers', and/or Authorized Contacts' and Imperial's respective rights, obligations, and liabilities;
  • Procedures for Resolving Disputes; and/or
  • The handling of sensitive data
Imperial will notify Members in Quebec via email or any other contact information we have for them prior to making any changes to the Program or these rules if those changes materially affect the Members in Quebec. In such notice, the new provision alone, or the amended provision and the provision as it read formerly, and the date of the coming into force of the amendment, shall be set forth. Changes to the Program or these rules that do not affect their essential nature will be communicated to Quebec Members by email from Imperial on or before June 12, 2020, in accordance with the language of the pre-revised version of this clause. or through any other means we deem appropriate, at least 30 days prior to the amendment taking effect, with the notice specifying either the new clause only, or the amended clause and the clause as it read formerly. and the implementation day of the change Imperial will also inform the Member of its no-cost cancellation or refusal of the amendment rights. If an amendment increases Members' obligations or decreases Imperial's obligations, Members may request a cancellation penalty or cancellation indemnity by providing Imperial with notice to that effect no later than 30 days after the amendment comes into force. If a Member does not notify Imperial of his or her decision to reject the amendment and withdraw from the Program within 30 days of the amendment's effective date, the Member will be deemed to have accepted the amendment and will continue to be a part of Consent to be bound by the amendment(s) will be deemed given if he or she keeps participating in the Program after the period has ended.

Despite the foregoing, Imperial reserves the right to make temporary, unilateral changes to any material aspect of the Program, including but not limited to any material aspect of these rules, in order to better serve a Member.

Notifications regarding the end, suspension, or resumption of the Program will also satisfy the aforementioned notice requirement(s). or amendment may also be (a) posted at Participating Stations, (b) posted at essoextra.com, (c) emailed to your email address on file, and/or (d) provided to any other contact information we may have on file for you, all as determined by us in our sole discretion. If the Program is cancelled, this Agreement will also end, and a Member's Points will expire at the same time; however, Imperial reserves the right, but has no obligation, to extend the expiration date for the Points beyond the cancellation of the Program. in its sole discretion, during which time these rules (other than those regarding the accumulation of Points) shall remain in effect

5.5 By accepting a prize, the Member waives any and all claims against Imperial, its affiliates and partners, and their respective advertising and promotional agencies, and the impartial judging organization. Imperial accepts no responsibility for missing or stolen prizes.

Please call the Customer Service and Support Centre (1-800-567-3776) or log into your account at www.essoextra.com to let Imperial know of any changes to your mailing or email address. Imperial accepts no responsibility for any mail or email that is lost, delayed, or misdirected. Imperial is not liable for any delays or failures that may occur during the recording or registration of Points.

Any federal or provincial income taxes that may be due as a result of the Member's receipt of any rewards are the sole responsibility of the Member.

5.8 Occasionally, Imperial may choose to extend privileged offers to qualified Members.

5.9 By joining the Program, the Member commits to following the rules set forth herein and elsewhere, including any future modifications thereto. By accepting the role of Authorized Contact, you are agreeing to be bound by all of the terms and conditions set forth in this document and elsewhere. Imperial reserves the right to terminate a Member's participation in the Program and cancel any outstanding Points due to the Member's or its Authorized Contact's violation, fraud, or abuse of the Program. If a Member, its Authorized Contact, or any Member with an interest in a joint account provides false information to Imperial or Imperial suspects, in its sole discretion, that a Member has provided false information to Imperial, Imperial may terminate the Member's Esso Extra card and account under the Program and cancel any accumulated Points and certificates. abuses the Program in any way, either as a Member or Authorized Contact Points under 5 are null and void. 9 for any reason are null and void, and cannot be exchanged for cash.

5.10 If a Member is not in good financial standing with Imperial, Imperial may suspend or terminate the Member's participation in the Program at any time, including after a request for Point redemption has been received.

5.11 Imperial maintains a separate file containing Member information submitted with an application for an Esso Extra card or subsequently provided for the purpose of Imperial promotions and the marketing of goods and services by Imperial alone or in conjunction with other third parties. A representative of Imperial maintains the Member's file on servers in Toronto, Ontario. Data that we collect may be stored in a cloud-based structure with servers located in both Canada and the United States. Consequently, we may transfer, store, and process your Personal Information on servers located in the United States and other countries whose data protection laws may differ from those of your country of residence. Accordingly, governments, courts, or law enforcement in those jurisdictions may request access to this information in accordance with the laws of those jurisdictions. Imperial will restrict access to the Member's file to its employees and its duly authorized representatives who require such access to perform their duties. Access to the Member's personal file is guaranteed. By participating in this Program, the Member agrees that Imperial may keep a file on the Member and may share information contained in that file with third parties for the purposes outlined above and below. Your name, Esso Extra member number, address, and postal code may be shared with Imperial's agents, dealers, and service providers. distributors or any company that has an ongoing business relationship with Imperial to investigate any suspected fraud or abuse involving Esso Extra cards or payment devices that include Esso Extra benefits like the Speedpass device or the Speedpass app. The Member may request access to, corrections to, or the deletion of his or her file by Imperial, as well as the withdrawal of his or her consent to the use or disclosure of information contained therein. The interpretation of these rules and any administrative or other procedures as may be established by Imperial from time to time, and the resolution of all disputes relating to the Program, shall be made by Imperial in its sole discretion with respect to Members residing outside the Province of Quebec. Imperial's decisions regarding Members and Authorized Contacts are final and binding. No matter the cause of action, negligence or otherwise, Imperial's liability under the Program is limited to the reissuance of redeemed Points or, if no Points were redeemed, to the payment of Canadian dollars. $0 A Member's or Master Member's liability is multiplied by $.0001 for each Point that was in their account and available at the time of the liability's occurrence. Any Member who requests that their Points accrue to a joint account waives any and all claims against Imperial, including claims based on negligence or breach of contract.

5.13 Imperial is the sole owner of the software. Imperial may delegate Program management to a successor organization or a third party at any time. Members who do not reside in Quebec are subject to the laws of Ontario and Canada as they apply to the Program and these rules. The Program and these rules shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein with respect to Members residing in the Province of Quebec.

This Section 5.14 does not apply where it would be illegal to do so under local law.
