BREAKFAST TELEVISION TORONTO (“BT”)
1. Scope of Rules: These guidelines govern contests run by Rogers Media Inc. (“Rogers”) for BT, except those contests that have specific rules developed for them. By participating in a contest regulated by these rules (a “Contest”), contestants agree to adhere to these rules and will be considered to have received and comprehended them.
2. Eligibility: Contests are open to individuals at least 18 years of age who are presently residents of Ontario. The following individuals are not eligible to participate in a specific Contest unless otherwise specified: (a) workers, officers, directors, agents, and representatives of (i) Rogers and its parent and affiliated companies, (ii) the applicable prize supplier(s), (iii) the applicable Contest judges (if any), and (iv) any and all other companies connected with the Contest; (b) individuals who have won a BT contest in the three months preceding the beginning of the specific Contest; and (c) people with whom the aforementioned individuals share residencies.
3. Verification of Identity: Rogers may request proof of identity and/or eligibility to enter a contest at any moment. Failure to offer such verification may result in disqualification. Any personal or other information requested by Rogers during a Contest's course must provide truthful, thorough, and accurate information. Rogers maintains the right to disqualify any entrant if that entrant provides untruthful, incomplete, inaccurate, or misleading personal details and/or information at any time.
4. Contest Duration and Prizes: Information about the prize(s) available to be won, the Contest's start and end dates, the start and end times, and any other relevant information will be given in applicable promotional materials, the website at www.bttoronto.ca (the “Website”), and/or by means of any of the official social networking pages for BT. The approximate retail value of a prize is available during the particular Contest entry period upon request. Prizes must be accepted as awarded, without substitution, transfer, exchange, or assignment, unless otherwise decided in Rogers' and/or the prize supplier(s)' sole discretion. Prizes are provided “as is” without further representation, warranty, or guarantee of any kind, whether express or implied. Rogers and/or the prize supplier(s) reserve(s) the right to substitute a prize or a component of a prize with a prize or a component of a prize (as applicable) of equal or greater value, including, without limitation, a monetary award, if the prize or prize component cannot be awarded by Rogers and/or the prize supplier(s) for any reason. Prizes may not be exactly as advertised.
5. How to Participate: No purchase is necessary. Unless otherwise specified, only one entry per person per Contest is allowed. A Contest's entry mechanism(s) will be noted on applicable promotional materials, the Website, by Rogers’s representatives and/or by means of any of the official social networking pages for BT. One or several of the following entry mechanisms may be applicable to any given Contest:
A. Online Entry: To enter a Contest through the Website, go to the Website during the applicable Contest entry period and click on the Contest banners, buttons, and/or links to access the online entry form for the Contest. During the applicable entry period, fill out the online entry form as instructed, including all required information. Incomplete entries will be deemed void. By successfully transmitting a completed entry as directed, you will be entered in the Contest.
B. Call-in Entry: To enter a Contest through call-in entry, dial the telephone number supplied by the on-air BT host when prompted and be the correct caller, as determined pursuant to instructions provided by the host (e.g., be the correct sequential caller). Once determined to be the correct caller, you may be required to follow the instructions of a Rogers representative to validate your eligibility (e.g. answer trivia questions).
C. Email Entry: To enter a Contest via email entry, follow the instructions to send an email to the email address supplied by the on-air BT host when prompted, subject to any content requirements as noted by the on-air host.
D. Social Media Entry: In order to participate in Contests that require entry through social networking pages or services, Entrants must follow the directions provided by Rogers (through its social networking pages, promotional materials, the Website, or Rogers's representatives) and submit their entry during the applicable entry period through a Third Party Service. To participate in a Contest through a Third Party Service, Entrants must possess a valid account with the applicable Third Party Service and may be required to have a non-private account. By creating an account with a Third Party Service, Entrants agree to comply with the terms and policies of the Third Party Service.
Although some Contests may be communicated, promoted, or administered by a Third Party Service, Entrants acknowledge that the Contests are not sponsored, endorsed, administered, or associated with any Third Party Service. Any comments, questions, or complaints regarding a Contest should be directed to Rogers, not to any Third Party Service. By participating in the Contest, Entrants fully release any Third Party Service from liability in the event of any injury, damage, or loss that may happen as a result of their participation. It is also worth noting that, unless explicitly stated, Contests have no affiliation with Apple.
6. Restrictions: Entrant Submissions. In some instances, Contest entry mechanisms may require Entrants to submit an original photograph, video, or written submission, which constitutes the "Creative Material," to Rogers, subject to instructions from Rogers or its representatives. By entering a Contest that requires a Creative Material submission, Entrants represent and warrant that their Creative Material is original and that they have all necessary rights, including those related to copyright, to enter the Contest. The Creative Material shall not include any defamatory, libelous, pornographic, or obscene content. It must not include (a) nudity, (b) explicit, graphic, or excessive sexual activity, (c) crude, vulgar, or offensive language and/or symbols, (d) derogatory characterizations of any racial, ethnic, sexual, or religious groups, (e) content that endorses or condones illegal, inappropriate, or high-risk activity, behavior, or conduct, (f) personal information of individuals without their consent, (g) commercial messages, comparisons, or solicitations for products or services, (h) identifiable third-party products/trademarks/brands/logos, or (i) any other content that Rogers deems inappropriate, unsuitable, or offensive. The Creative Material submitted with an entry shall not be returned to the Entrant and may be refused as a Contest entry at Rogers' absolute discretion. By entering a Contest that requires a Creative Material submission, Entrants grant Rogers a worldwide, perpetual, royalty-free, irrevocable, non-exclusive, and unlimited license to use their entry, including the Creative Material, for any purpose related to the Contest in any media, and waive all claims of copyright and moral rights in the Creative Material, and any rights to compensation relating to any use, reproduction, modification, adaptation, translation, alteration of, or creation of derivative works from, the Creative Material by Rogers. Entrants further agree to indemnify and hold harmless each of the Releasees (defined below) from and against any and all claims or actions brought by a person whose consent was not obtained by you, or by any person claiming that his/her/its intellectual property rights, moral rights, or personality or privacy rights are infringed by the Creative Material or by Rogers's use of the Creative Material in accordance with these rules.
7. Ineligible Attempts at Entry. Any attempted or suspected attempt to enter a Contest in a manner not authorized by these rules or by Rogers or its representatives constitutes tampering and renders all entries void. Entries that contain false information, are late, lost, unauthorized, stolen, damaged, falsified, illegible, garbled, misdirected, mutilated, incomplete, altered, or otherwise irregular, or entries submitted using robotic, automated, programmed, or illicit means or that do not satisfy the rules as determined in Rogers's sole discretion, are null and void and will be disqualified. Only entries received by Rogers will be considered. Proof of entry transmission does not constitute proof of receipt. The Website server machine(s) will be the sole determinant of time for valid online entry in a Contest.
8. Random Selection: In Contests where a winner is chosen from received entries, a random selection shall be conducted by a Rogers representative from all eligible entries by the Contest deadline. Failure to adhere to these regulations or failure to contact the selected entrant within a reasonable timeframe, as decided by Rogers, will result in disqualification and forfeiture of any claims to the Contest’s prize. All decisions and judgments from Rogers or its agents shall be final and without appeal in any Contest-related matters, including the distribution of prizes.
9. Winning Conditions: In order to be declared the winner, the selected entrant must correctly answer a timed mathematical skill-testing question without assistance of any kind. Additionally, the entrant must comply fully with the regulations and, at the discretion of Rogers, sign and deliver a release of liability form, consent to publicity form, and any other documents required by Rogers in its sole discretion.
10. Prize Acceptance: Upon claiming a prize, the selected entrant may be required to present an identification verification document. Once the verification procedure is completed according to the regulations, prize distribution shall be arranged by Rogers or any other prize supplier(s).
11. Winning Probability: The chances of winning depend on the number of eligible entries for each Contest and any other criteria described for the Contest’s entry.
12. Privacy: By participating in the Contest, you agree to the collection, use, and disclosure of your personal information by Rogers solely for Contest management in accordance with the Rogers Media Privacy Policy. An entrant’s consent to receive commercial emails and other communications from Rogers or other parties is entirely voluntary, and participation in the Contest is not contingent on an entrant’s consent. Electing to receive these materials shall not impact an entrant’s chances of winning. To opt out of such communications, follow the unsubscribe instructions at the end of every email. For further information on how Rogers collects, uses, and discloses personal information, consult the Rogers Media Privacy Policy. Any queries regarding communications from Rogers shall be referred to the Rogers Chief Privacy Officer, as outlined in the Privacy Policy. Entering a Contest via a Third-Party Service indicates your agreement to allow your personal information to be used by the applicable social networking service under its own privacy policy.
13. Liability Release and Publicity Agreement: By participating in the Contest, each entrant agrees to be legally bound by all regulations, eligibility requirements, and decisions by Rogers or its agents or independent judges (if any). Entrants waive their right to hold the Releasees (Rogers, its parent and affiliate companies, Contest prize suppliers, Contest judges, other Contest-affiliated companies, and all their employees, officers, directors, agents, representatives, shareholders, successors and assigns) liable for any injury, damage, or loss occurring directly or indirectly from participating or attempting to participate in the Contest, receiving or misusing any prizes, or engaging in any travel or activities associated with winning a prize. Each winner of the Contest also agrees to allow Rogers and its representatives to use the winner’s name, city and province/territory of residence, photograph, image, likeness, voice, and any statements they may make regarding the Contest prize in any related publicity worldwide and perpetuity, without additional compensation, permission, or notification, unless prohibited by law, and waives any existing rights related to materials created pursuant to these terms.
Limitation of Liability: The entities released from liability in this contest shall not be held accountable for the following: (i) incomplete, inaccurate, illegible, lost, stolen, misdirected, scrambled, delayed, undelivered, postage-due or garbled mail, transmission, email or entries; (ii) server, internet, cable, network, satellite, website or any other types of connection interruptions or unavailability, including those through or via websites; (iii) computer hardware or software malfunctions, delays, delays, or misdirected transmissions or jumbled or scrambled difficulty; (iv) phone line or phone system malfunction, processing error, omission, interruption, communication error, or delay in transmission of phone calls; (v) email notifications delivered with delays or blocked; (vi) errors, misprints, typos in any of the contest rules, contest-related ads and materials; (vii) any difficulties or problems of any type - whether typographical, network, mechanical, mail-related, telephone, electronic, computer, human, or otherwise - concerning a contest, including any difficulties or errors linked with processing entries, providing the prize, or the announcement thereof; or with materials referencing that contest or cancellation/postponement of any event occurring in connection with the contest. Further, the releasees are not responsible for incorrect or inaccurate data, whether caused by user or hacking activities, web traffic, or hardware or programming used in contest operations. Lastly, the releasees are not accountable for computer damage or harm to participants or any other person, whether from downloading material from or using the site or participation in any contest.
Laws and Rules: Unless mentioned before, all contests will be run as per the rules stated here. The rules may be modified, amended, or terminated by Rogers at its discretion without prior notification or legal responsibility for any reason. The contests are subject to the established state, provincial, and federal rules and regulations. These rules are exclusively governed by the laws of the province or territory, and filing any disputes will fall under the jurisdiction of the said courts.
Cancel and Amend: Rogers reserves the right at any moment to alter, amend or cancel a Contest or the rules surrounding it for any reason by giving any prior notice. In case of unusual events that could not have been predicted; Rogers has the right to cancel, suspend, or declare void the contests. Rogers could also hold a random draw from winning entries received before suspension.
Conduct: In its sole discretion, Rogers reserves the right to disqualify an entrant without notice for violating any contest rules, tampering, intending to disrupt or undermine a contest's operation, or intending to cause physical, emotional harm or harassment to any participant. Such an attempt could lead to criminal or civil investigations, and if found guilty, the entrant may be banned from the contest and future contests.
Identity of an Online Entrant: If a situation arises where the identity of a contest entrant is questioned, loyalty club entrant, social media entrant, or any other online entrant, the entry will be retained and designated as submitted by the authorized account holder responsible for said account when the entry was made. If the contest administrator doubts the authorization and identity of the entrant, the individual may be asked for further clarification. If the account holder's name is different from the full names provided in the entry, that entry may be disqualified.
